Terms and Conditions

1. Introduction 

At Safety Tech NZ, we are dedicated to providing top-quality personal protective equipment (PPE) and safety solutions for diverse industries. Our extensive range includes respiratory protection, spill response kits, site safety gear, protective coveralls, hand protection, and eye/face protection. We also specialize in storage solutions for hazardous materials, ensuring safety in every environment. Our commitment is to safeguard your team with the highest standards in safety and reliability 

2. Definitions 

  • Company/Seller  (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to SAFETYTECH or seller, Auckland, New Zealand. 
  • Goods refer to the items offered for sale on the Service. 
  • Orders mean a request by You to purchase Goods from Us. 
  • Service refers to the Website. 
  • Website refers to safetytechnz, accessible from www.safetytechnz.co.nz 
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. 

3. Ordering and Payment 

Ordering Process 

The following provisions apply to orders for Goods: 

  • Orders must be placed in accordance with procedures from time to time laid down by Seller. 
  • Orders shall be deemed accepted by Seller when accepted in writing or, in the absence of written acceptance, upon dispatch of the Goods by Seller. Orders for Goods may be accepted by Seller in whole or part. Acceptance of orders is at Seller’s sole discretion. 
  • Seller may cancel or amend any order for Goods which in the opinion of Seller is impractical or uneconomic to supply. 
  • Once an order has been accepted by Seller, it may not be changed or cancelled by Customer without the prior written consent of Seller. 
  • If a quotation is provided by Seller, that quotation is an invitation for Customer to trade with Seller, but does not constitute an offer by Seller. A quotation shall remain valid for the period stated in the quotation and if no period is stated. Any modification to any quotation is effective only if Seller puts it in writing. 

4.Payment 

  • Pricing: Customer shall pay to Seller in respect of all Goods supplied by Seller or any Related Company of Seller to Customer or any Customer’s Representative the Seller’s Price for those Goods as at the date of delivery of those Goods. 
  • Freight and taxes, etc: All prices are exclusive of GST. 
  • Payment: Payment for Goods, and any other charges associated with Goods, is due on receipt of invoice for those goods. All payments shall be made in New Zealand dollars. Payment shall be made in cleared funds.  
  • Customer shall not be entitled to withhold payment or make any set off or deduction from the price of Goods supplied or from any other payment due by Customer. 

5. Shipping and Delivery 

  • Goods shall be deemed to be delivered when delivered to Customer’s premises. If Customer fails or refuses delivery to take or accept delivery then the Goods shall be deemed to have been delivered. 
  • Seller may deliver Goods by instalments and each instalment shall be deemed to be a separate contract under the same provisions as the Contract. If Seller fails to deliver one or more instalments this will not entitle Customer to repudiate the Contract. 
  • Any quotations of delivery times by Seller are estimates only and not commitments. Seller shall not be bound by such quotations. If no dates are specified, delivery shall be within a reasonable time. 
  • Seller shall not be liable to Customer for non-delivery or delay in delivery. 
  • Seller will not consider any claim that all the Goods ordered have not been delivered unless Customer makes a written claim to Seller within two Business Days of delivery. 

6. Returns, Refunds, Cancellations and Exchanges 

Acceptable Returns  

  • Goods purchased in the last 5 Business days and returned  
  • Goods must be in its original packaging  
  • Restocking fees apply for returns incorrectly ordered.

 

Unacceptable returns  

  • Goods supplied to your specifications or clearly personalized. 
  • Goods which supplied according to their nature are not suitable to be returned, deteriorate rapidly or where the date of expiry is past. 
  • Goods supplied which are not suitable for return due to health protection or hygiene reasons and are unsealed after delivery. 
  • Goods supplied which have been after delivery inseparably or mixed with other items. 
  • Goods incorrectly order by the customer. 

 

Refund Process  

  • To request a refund, contact our support team at [email protected].
  • Once your request is reviewed, we will notify you of the approval or rejection of your refund.
  • If approved, your refund will be processed to your original payment method within 5days.

 

We reserve the right to refuse returns of any merchandise that does not meet the above return conditions in our sole discretion. 

Goods supplied on sale cannot be refunded. 

It is your responsibility for the cost and risk of returning the Goods to Us. Goods are to be returned to the address supplied once your return has been accepted. 

We will not be held responsible for Goods damaged or lost in return shipment. Therefore, we recommend goods are insured and you use trackable shipping service.  

7. Your Order Cancellation Rights 

Your Order Cancellation Rights are governed by the Consumer Guarantees Act. 

Replacements and refunds are known as remedies. You can ask for a remedy under the Consumer Guarantees Act (CGA). You should be able to get a repair, replacement or refund if: 

  • products or services don’t do what they are meant to, or are defective 
  • products or services are different from their description, eg on packaging or in advertising 
  • products don’t match the sample or model you were shown 
  • products or services are not reasonably fit for a particular purpose you told the seller about.
